Musicasm Terms Of Use

This policy outlines the Musicasm terms and conditions of usage.

Agreement to Terms

By using the Musicasm application (the "App"), you agree to be bound by these Terms. If you don’t agree to be bound by these Terms, do not use the App.

Who May Use the App

You may use the App only if you are 9 years or older and are not barred from using the application under applicable law. To make a purchase via Musicasm application (described in the Section titled “Purchases” below), you must be 18 years or older and capable of forming a binding contract.

Service Rules and Conduct

The App is provided only for your own personal, non-commercial use. You shall not (and shall not permit any third party to) either (a) take any action or (b) download, submit, link to or otherwise distribute or facilitate distribution of any content on or through the App, that infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity.

Copyright Policy

Content specifically provided by Musicasm or its partners may be protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. Musicasm takes copyright and other intellectual property rights very seriously. If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the App, you must submit your notice in writing to the attention of "Copyright Infringement" at alex@ledak.ru (Mr Aleksey Ledak, developer of the App) and include in your notice a detailed description of the alleged Infringement.

Limitation Of Liability

In no event shall Mr Aleksey Ledak, nor his partners, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

(a) your access to or use of or inability to access or use the App;

(b) any conduct or content of any third party on the App;

(d) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory

Purchases

Fees

The App offers certain enhanced features of the application which you can purchase as a monthly or yearly subscription (“Subscription”). A description of features associated with Subscriptions is available via the application. The amounts due and payable by you for a Subscription that you purchase through the application will be presented to you before you place your order. If you choose to purchase a Subscription, you agree (a) to pay the applicable fees and any taxes; (b) charge your account with the Apple App Store; and (c) to bear any additional charges that your App Provider, bank or other financial service provider may levy on you as well as any taxes or fees that may apply to your order. All payments made are non-refundable and non-transferable.

Subscriptions Automatically Renew Until You Cancel & How to Cancel Your Subscription

Your subscription will be charged to your iTunes account at confirmation of purchase and will automatically renew (at the duration selected) unless auto-renew is turned off at least 24 hours before the end of the current period. Current subscription may not be cancelled during the active subscription period; however, you can manage your subscription and/or turn off auto-renewal by visiting your iTunes Account Settings after purchase. Changes to Terms or Services

I may modify the Terms at any time, in my sole discretion. It's your own responsibility to remain informed of the current Terms of Use including all other named policies included by reference therein.
